It has been a little over two years since the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) Internet applicant regulation went into effect. Career center staff and employer recruiters are learning to contend with the challenges presented by this rule.
What was meant to be a recordkeeping rule has had a far reaching impact on the career services and recruitment function. Understanding who is an "applicant," what records must be kept, who is responsible for what, and how the OFCCP threatens to turn a failure to hire into a discrimination case, are crucial steps to safe and intelligent handling of responsibilities under the rule.
Unwary recruiters can be swept up into the decision-making process and find themselves as witnesses in discrimination allegations.

The Presenter
Matt Halpern is a partner in the Long Island office of Jackson Lewis LLP and is the head of the firm’s Affirmative Action Practice Group. Halpern regularly advises and counsels employers from all industries throughout the country about this highly specialized area of the law. Halpern has conducted many management training seminars on lawful pathways to diversity, affirmative action, and EEO in the workplace; avoiding litigation; avoiding discrimination and sexual harassment; effective management, interviewing, documentation, and evaluation skills; and compliance with the Americans with Disabilities Act and FMLA.
